David Vs Goliath has been established as a campaign and support group for franchisees. It is always good to know that you are not alone. The long-term aim is to achieve regulation of franchising in the UK. Currently, the UK has no regulation in place unlike other countries such as the US and Australia. Along the way it is hoped to be able to provide advice, guidance, and grants to enable franchisees to negotiate and if required litigate regarding their franchise/business. Winning litigation will provide stated cases to help other franchisees whilst the campaign for regulation moves forward. Franchisors use the legal system, including NDA’s (non-disclosure agreements), and gagging orders, to keep people quiet and prevent the complete picture of the business from being available to others. At the moment, many franchisors can sue franchisees personally for breach of contract, whatever the circumstances, i.e. if the business isn’t viable, bereavement, illness, etc. Many have used savings, redundancy payments, pensions or loans to become franchisees and find themselves at risk of losing families, homes, and livelihoods. It is acknowledged that there is a place for franchising within the business structure of the UK. But, there is a clear argument for it to be regulated, transparent and mutually beneficial for both franchisor and franchisee
